Model Indemnity and Release Form

1. This document constitutes a binding contract between

Model (name in print) and SUSANNA SMITH Photographer,

regulating the ownership and use of photographs and derivative works based thereupon, taken by the Photographer of the Model

at (photographic shoot location)

for Photographers own artistic work (description of photographic shoot)

on (date) for all lawful purposes,

subject to the terms and conditions described below.

2. Delivery of 8-10 photographs taken for the photographic shoot (mentioned in paragraph 1) will take place after the editing has been completed as payment for the Models time (max 1 hour in the water). The photographs will be on CD format. The photographer will contact the Model in this regard. This delivery constitutes the whole obligation of the Photographer towards the Model.

3. The Model agrees that copyright, moral rights, and all other intellectual property rights to the photographs mentioned in paragraph 1. and ALL other Photographs taken for the specified photographic shoot mentioned in paragraph 1. belongs to the Photographer and/or his/her heirs, licensees or assignees, with full right of lawful disposition in any manner.

4. The Model agrees that, while he/she may use the photographs for purposes related to their private use, the Model will not sell or otherwise transfer publication rights to any of the photographs without the Photographer’s prior consent.

5. The Model understands that the Photographer has moral right to be identified as the author of the photographs when copies of the photographs are presented to the public, and shall communicate this understanding to publishers, designers and other third parties that act on the Model’s behalf to create presentation material using the photographs.

6. The Model agrees that the photographs shall not be cropped, altered or distorted in any way whatsoever. Any watermark and copyright notice that appears as part of a photograph must be left intact.

7. The Model releases and agrees to hold the Photographer and/or his/her heirs, licensees or assignees, harmless from any claim or liability in connection with the publication or use of the photographs mentioned in paragraph 1. by reason of any distortion or alteration and any reproduction or adaptations thereof, in whole or in part, alone or in composite or altered form editorial or any other purpose in any manner or form whatsoever, unless it can be clearly shown that the foregoing was maliciously caused, and produced, and published solely for the purpose of subjecting the Client to conspicuous ridicule, scandal, reproach, scorn or indignity. The Model waives any right to inspect or approve the finished use of the photographs.

8. The Model hereby affirms that all poses, positions and situations enacted in the photographs covered in this release were entered into without force, coercion, or threat whatsoever, and where posed freely by the Model with the ModelÕs full consent. The Model further agrees to hold blameless and free of all accusation of such force or coercion the Photographer, his legal representatives, assigns, and those acting under his permission.

9. The Model hereby affirms that his/her date of birth is / / and that the Model is fully able to enter a contract in his/her own name without breach of any prior agreement or applicable law, including, but not limited to, prior agreements with modeling and talent agencies.

10.The Photographer can not be held responsible for incorrect contact details provided by the Model in any way whatsoever. If the Model's contact details change, the onus lies with the Model to relay the new contact details to the Photographer.
